How You Pay Online Taxes at Stake in South Dakota v. WayFair
(Washington D.C.) The US Supreme Court is set to hear arguments in South Dakota v. WayFair. The State of South Dakota is bringing a case against WayFair, a large online retailer, for not paying sales taxes on sales in South Dakota.
Many other states are closely watching this case as states claim they are losing billions in tax revenue from online sales to citizens of their states. Online retailers, large and small, argue that the complexity of dealing with more than 12,000 taxing authorities in the United States is burdensome, costly, and that taxation by states against businesses outside their borders violates the Federal Commerce Clause of the US Constitution.
